Well, i'm kind of fed up with this bullshit, so i might as well ask you guys.
we have a contract for a 5mb/s internet speed
speetest says im at 4.83mb/s max
but when i'm downloading, the MAX i get is 500kb/s where'd the other 4.3mb/s go?

It's not just based on your speed, but the speed of the person you're getting it from, how far away you are, etc.
eg; I can download from a server close to me at 1.5MB/s, but everywhere else it's basically a max of 800KB/s.
Edit: That's actually one thing I hate about some ISPs. They advertise "DOUBLE THE SPEED!" but it's just a cheap way to get more money when you'll probably never hit your actual cap more than once a month.

You're probably confusing the units. 1 kilobyte (KB) doesn't equal 1 kilobit (Kb). 8 kilobits in a kilobyte (8Kb in 1KB). So a 5Mb connection would only max out at 625KB/s. You also have to factor in not only the distance from the server, but whether the server's bandwidth is already red-lining.
That's assuming you have your units wrong. Which is the likely case with this.

Usually (at least for Firefox), it shows the download speed in kilobytes (KB). As with torrenting applications such as uTorrent and Usenet clients like alt.binz. It's really universal actually; I rarely find applications that measure speed by kilobits.

Your ISP and that speedtest website measure them in kilobits (to make it look like you are getting more... to average joes).
so 5mb/s is how much the ISP gives you... 4.83mb/s is what you get after factoring in:
*Other Connections on your computer
*Other connections on your router
*The speed/bandwidth of the relaying server...

5mbits/s = 625kbytes
This is factoring in:
*Other Connections on your computer
*Other connections on your router
*The speed/bandwidth of the relaying server...
Which knocks it down probably to... 500kbytes! Which firefox states you download at!

My ISP said my Max will be 10mb and I download at 1Mb/s...

My ISP said that I would get an average of 5 MEGABITS per a second and my speedtest shows 11 MEGABITS per a second.

That's how your internet is. I depends on how many people are downloading from the node which provides internet for your whole neighbourhood.
I get way fast internet speed @ 2AM-9AM and really slow from about noon till the evening. It's all about who else is using the internet.
Also it might be slow because you are downloading from a sauce that has a slow upload.

Actually, most ISP will say up to xx MB/S. I'm on a 1.35 MB/S, but my max download speed I ever get is around 170 KB/S.
This is how you really find out your speed:
I'll use my line as an example (1.35MB/S) so you convert that into kilobytes which = 1382.4 KB
Now you divide it by six, so my download speed is:
1382.4/6 = 230.4 KB/S (at least it should be, but this is just a rough estimate, there are other things that come into play as well, stated above)

Often, cable companies will pump a little extra juice through the lines to compensate for usage, I've read. Speed comes down to a lot, though.
(Just don't fuck about with Verizon.

I pay for five and this is what I get...
When I call them, they say, whoah that's pretty high, the average customer gets about half the speed they pay for, you are lucky... (Not verbatim, but he basically said that)

It's called advertising...a "fallacy."
Most businesses lures their customers by using methods that will definitely lure possible customer/s. Usually showing them pictures and/or figures that at first glance may look inviting.
Better learn to read between the lines and start asking questions and clarification >.<

Ram? Depends on specs. If you have specs enough you will be able to use the ISP to it's full advantage. What ISP, anyway? Ah; Iinet, I see. Well I suggest Fios, or Roadrunner High Speed (Time Warner).
